先住民族の?利に?する?際連合宣言 （せんじゅうみんぞくのけんりにかんするこくさいれんごうせんげん、 英 : Declaration on the Rights of Indigenous Peoples , 略?：UNDRIP）は、 2007年 、 ニュ?ヨ?ク の ?連本部 で行われていた第61期の ?際連合?? において採?された ?際連合??決議 [1] 。

??決議には ?際法 上の 法的拘束力 はないが、?連?報官は「同宣言は?際的な法律基準のダイナミックな?展を意味し、また ?際連合 の加盟?の?心や??が一定の方向に動いたことを示した」としている。同宣言は、「世界の 先住民族 の待遇を整備する重要な基準であり、これはこの惑星の3億7000万人の 先住民族 に?しての 人?侵害 を無くし、彼らが 差別 や マ?ジナライゼ?ション （周?化）と?うのを援助するための疑う余地のない重要なツ?ルである」と評した [2] 。

宣言は、「文化、アイデンティティ、言語、??、健康、?育、その他の問題」に?する彼らの ?際法 に承認された人?の享受の?利と同?に、個人と共同の先住民族の?利を順に?明する。宣言は、自身の慣習、文化と?統を守り、?化し、彼ら自身の必要性と目標に合わせて彼らの?展を?行するために、先住民族の?利を?調する。 [2] 　同宣言は、先住民族に?する差別を禁止し、それは彼らを心配させる全ての問題への彼らの完全で有?な?加を促進し、そしてまた、彼らの?利を明確に保持し、彼ら自身が目指す ?? ?社?的開?の??を促進する。 [2] [3]

交?と批准 [ 編集 ]

宣言は採?までに起草から22年以上?過した。 1982年 に ??社?理事? (ECOSOC) はホセ?マルチネス?コ?ボ 特別報告者 の先住民への差別問題に?する調査報告書を受け、 ?際連合先住民作業部? (WGIP) を立ち上げた。先住民保護のための人?基準を開?することを任務とし、 1985年 に、作業部?は先住民族の?利宣言の草案策定に取り組み始めた。草案は 1993年 に仕上がり、 少?者の差別防止および保護に?する?連人?小委員? に提出され、翌年に承認された。

宣言草案は 人?委員? に諮られ、別の作業部?が設けられた。翌年にかけ、作業部?は、宣言草案の?念と?項を調査し、微調整するために11回の?合を持った。宣言のいくつかの基本?項（例えば先住民族の 自決 ?と先住民族の?統的な土地に存在する天然資源の管理）に?して、特定の?家が懸念したため、進?が?れた [4] 。

宣言の最終版は、 2006年 6月29日 に ?際連合人?理事? （人?委員?への後?組織）の47理事?のうち?成30、反?2で採?され、棄?12と欠席3があった [5] 。

潘基文 ?際連合事務?長 は「?連加盟?と先住民族が痛ましい?史を重ね、人?と正義と全ての人?のための開?への道へ共に進み解決を?る?史的瞬間だ」と述べ、反??であるカナダ出身の ルイ?ズ?アルブ?ル 人?高等弁務官 も、それまでの激務と忍耐が「これまでの先住民族の?利宣言の中でも最も包括的なものとして?った」ことに?足を示した [3] 。

採?に臨んだ ボリビア の デビッド?チョケワンカ 外相は、反?及び棄?した加盟?が彼が 世界人?宣言 と等しく重要と評?するこの宣言を拒絶したことを再考することを望んだ [8] 。宣言の採?のニュ?スはアフリカでも?迎された [9] 。

一方、宣言の支持者の多くが、ほとんど先住民市民のいないヨ?ロッパ諸?（例えばデンマ?クとドイツ）や先住民族の?利を尊重してきた記?の乏しいラテンアメリカ諸?であることに注意すべきとする意見もある [10] 。

反?した4ヶ?は、いずれも共通の文化的基盤を持つ 英語? の? イギリス植民地 であり、 コモン?ロ? により一定の先住?が認められている [11] 。

この4カ?は政?交代等を?て宣言への支持あるいは支持に前向きな意志を表明。 ただし、自由、事前の インフォ?ムドコンセント 、FPIC(FREE,Prior and Informed Consent)に基づく先住民族の拒否?については認めていない。 [12]

オ?ストラリアのマル?ブラフ家族コミュニティサ?ビス先住民族問題??相は先住民族の慣習的な法?系を維持する?項について「全オ?ストラリアでの立法?置を必要とするものであり、現代世界の法律?務では受け入れられないものを祭れない」と述べた [6] 。

政?交代後の2010年4月にはオ?ストラリア同?に宣言への支持を表明。


カナダ [ 編集 ]

カナダは議決に先立ってインディアン?北部開?相と外相が共同?明を?表、「カナダの憲法システムと全く?立しない?項を含んでおり、根本的な欠?がある」と述べ、決議を批判した。さらに「?該決議は、土地、資源に?しての?利について、先住民族とそのほかの人?との調和を?らなければいけないカナダの立場を理解していない」とも述べた [13] 。?連大使もオ?ストラリアと同?に宣言の?項が現行?際法になじまない旨を指摘した [14] 。

しかし、2015年に政?を奪還した カナダ自由? のもとでカナダは方針を?換し、2021年に宣言の遵守法案(C-15)が可決されている [15] [16] [17] 。

アメリカ合衆? [ 編集 ]

アメリカ?連大使 は?初、反?した??と同?の理由に加え、「先住民族」の定義が宣言に盛り?まれなかったことから反?した [18] 。

2010年 12月16日 には オバマ大統領 は宣言に調印する用意があると?表し、先住民族の首長に?して合衆?政府と?該民族との間の?係改善を?り、破られてきた約束を回復させると?えた。現存するアメリカ??の先住民族は560以上を?え [19] 、その多くがオバマ大統領の?表を?迎したが [20] 、2022年現在採?には至っていない。

    TAKAHIRO SHINYO ( Japan) said that his delegation had voted in favour of the Declaration. The revised version of article 46 correctly clarified that the right of self-determination did not give indigenous peoples the right to be separate and independent from their countries of residence, and that that right should not be invoked for the purpose of impairing the sovereignty of a State, its national and political unity, or territorial integrity. The Japanese Government shared the understanding on the right and welcomed the revision.
    Japan believed that the rights contained in the Declaration should not harm the human rights of others. It was also aware that, regarding property rights, the contents of the rights of ownership or others relating to land and territory were firmly stipulated in the civil law and other laws of each State. Therefore, Japan thought that the rights relating to land and territory in the Declaration, as well as the way those rights were exercised, were limited by due reason, in light of harmonization with the protection of the third party interests and other public interests.
