their FAQ page
that permission is needed for public use of the picture. Even so, I presume that a low-res cropped version of the Van Hoof photo would be covered by fair use for use in
Matthew Shepard
because Shepard is deceased, a notable person of historical importance, and no other picture is available. This rationale for fair use only for the purpose of illustrating Matthew Shepard in the article about him.
I have contacted the Matthew Shepard Foundation for permission to post a picture covered under GFDL. I got a reply saying that a decision would follow, but it has been several week without a reply. I'm e-mailing them again for permission. --
