大韓民國現行著作權法第39條부터 第43條 까지의 內容에 따르면, 大韓民國의 管轄 아래 있는 모든 著作物은 著作者(共同著作物은 맨 마지막으로 死亡한 著作者)가 死亡한 後 70年, 法人等이 作成한 業務上著作物은 公表한 때부터 70年이 經過하면 著作財産權이 消滅됩니다. (1953年以前에는 30年, 2013年 7月以前에는 50年)

또한 現行著作權法第49條 에 依해 個人인 著作財産權自家相續人 없이 死亡하거나, 法人 또는 團體가 解散되어 民法 또는 그밖의 法律에 依해 著作財産權이 國家에 歸屬 될 때도 著作權이 消滅합니다.

區著作權法(法律第3916號, 施行 1987.7.1.) 附則第2條第1項 및 區著作權法(法律第432號, 施行 1957.1.28.) 第35條第1項, 第36條, 第37條, 第39條에 따라, 1976年 12月 31日以前에 창착된 寫眞著作物 및 寫眞術과 類似한 方法으로 製作된 寫眞著作物은 著作財産權이 消滅되었습니다.
